Nature of the Agreement

These Terms of Service govern your use of the public parts of our website and any engagement letter that you sign before we begin chargeable advisory work. Where we enter a separate written engagement agreement with you for a particular advisory service, that document works together with these terms and, if the two ever conflict, the more specific engagement agreement controls the matter it covers.

We describe these terms as a guide to fair dealing rather than a set of hidden traps. Our intention is that you should understand, before you begin, what we will do, what we will not do and where responsibility rests at each stage.

Advisory, Not a Guarantee

The information we provide is advisory in nature. It is offered to help you make your own informed decisions about mortgage readiness and financing strategy. No guidance we give should be read as a promise that a particular lender will approve your application or that a particular rate will be available to you.

Mortgage decisions rest finally with lenders and insurers, whose criteria change and who apply their own underwriting judgment. We work to present your case in the clearest light, but we do not guarantee an outcome. Where you must rely on the accuracy of your own documents and statements, that responsibility remains yours, and we ask that you always be truthful about the information you present.

We also want to be explicit about the boundary between our role and the role of a legal or tax professional. Home financing draws in rules about purchases, taxes and agreements that sometimes deserve a specialist view beyond general advice. We are happy to flag when a question falls outside our own lane and to encourage you toward a legal or tax advisor for that specific point, rather than stretching a friendly general answer into territory where it does not belong.

Home financing advice is guidance toward a decision; only the lender can approve the loan. We are honest about what depends on factors we cannot control.

Our down payment planning programs set realistic targets and show the sources of funds that may be available to you. Our credit readiness coaching works to improve your credit file well ahead of an application.

We also support the mortgage application itself by helping assemble documents and comparing offers, offer refinancing guidance to owners looking at renewal or equity release, and provide post-closing homeowner education so that your first year with a mortgage feels known rather than uncertain. Eligibility to Use Our Services

Our services and advisory content are intended for adults who are able to enter into binding agreements in their own right. To use our services you confirm that you are at least the age of majority in the province where you live and that you are acting for yourself, or with clear authority if you act on behalf of a household or business.

We reserve the right, at our reasonable discretion, to decline an engagement where we cannot serve a person responsibly. Where we are unable to help, we will tell you so honestly and, where useful, point you toward another path forward.

Your Account and Responsibilities

Certain parts of our work may call for you to share documents and preferences through private channels. Where we set up secure access for you, you are responsible for keeping your access details confidential and for any activity carried out under them. Please tell us promptly if you believe your details have fallen into the wrong hands.

You agree to provide us with accurate and current information for the purpose of receiving advice. If a detail changes, such as your address or the structure of your household income, we ask you to update us so that our guidance stays relevant to your real situation.

Your openness makes our honesty possible. When figures are shared in good faith we build on them with confidence, but when something has been withheld or shaped to look stronger than it is, the plan we build becomes less useful and a lender review can stall embarrassingly close to the finish line. We would always rather work with the real, comfortable picture than a polished one that cannot hold its shape at the lender desk.

We aim to answer messages within one working day and to keep you informed of progress at every meaningful stage. If you send us confidential material, we encourage you to let us know that it is sensitive so that we handle it with the care it deserves.

When we help you toward an application, the mortgage contract you ultimately sign is between you and the lender. Nothing we write in these terms, in our advisory notes or in any engagement letter overrides the binding obligations you accept directly with a lender or insurer.

We will point you toward the important clauses of any lender document you face and encourage you to read it independently. In the event of disagreement, the lender document you sign governs the loan, while these terms govern the way we conduct our own advice to you.

Acceptable Use

You agree to use our website and our advisory channels responsibly. In particular you will not attempt to disrupt the operation of the site, try to gain unauthorised access to our systems, submit false information intended to mislead us, or use our services to commit a fraud against any lender or person.

We welcome questions and honest disagreement, and we will always treat a direct enquiry seriously. Behaviours that are abusive, threatening or intended to harm our team or other clients fall outside the spirit of these terms and may lead us to end an engagement.

By the same measure we value your time as we value our own, which is why we keep the website free of intrusive tricks. There are no misleading countdown timers, no fake urgency and no claim that a rate will vanish tonight unless you sign at once. Pressure is a sign of a bad partner, and we are committed to a tone that lets a considered decision breathe.

Bundling that risk back into every ordinary fee would push honest guidance out of reach, and none of us want that.

We are not liable for losses that our reasonable efforts could not have prevented, including changes in lender policy, delays caused by parties outside our control, or the consequences of inaccurate information you supply. Nothing in these terms limits any liability that cannot lawfully be limited, and nothing removes your right to raise a genuine concern with us.

Indemnification

You agree to indemnify and hold harmless FHA Solutions Inc and its staff from any claims, losses, damages and reasonable costs that arise from your breach of these terms, your misuse of the website, or your supply of false or misleading information to us or to a lender through our advice.

This clause is intended to protect us from liability that you create through your own actions, not to place an unfair burden on you. We will only rely on it where a claim flows directly from your conduct rather than from a failure on our side.

Changes to the Service and Terms

Suspension and Termination

You may withdraw from our advisory relationship at any time by letting us know through any of our contact channels. Where chargeable work has been done up to that point, it is billed fairly for the time and effort genuinely spent, and we will release reasonable copies of documents that belong to you.

We may suspend or end an engagement where you misuse our services, supply information dishonestly or act in a way that is harmful to our team or suppliers, giving notice where doing so is practical and responsible. Ending an engagement does not remove obligations under the clauses that are meant to survive, such as those on liability and intellectual property.

Governing Law

These Terms of Service are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in that province, without regard to conflict of law rules. You agree that the courts of Ontario will have jurisdiction over any dispute that relates to these terms.

Before resorting to formal proceedings, we invite you to raise any concern with us directly so that we have the chance to resolve it fairly and quickly, in the spirit of the open relationship these terms describe.
